What the court decided
Two years after RN (Returnees) Zimbabwe CG [2008] UKAIT 00083, the Upper Tribunal updated the country guidance on Zimbabwe and found there is significantly less politically motivated violence than at the time of RN. As a general matter, a failed asylum seeker returning from the UK who has no significant MDC profile will not face a real risk of being required to demonstrate loyalty to ZANU-PF. A returnee to a low- or medium-density area of Harare will in general face no significant difficulties, and a returnee to Bulawayo will in general not suffer adverse attention from ZANU-PF or the security forces even with a significant MDC profile; risk remains more fact-specific in high-density and rural areas. The decision also gave Article 8 guidance that long residence (over seven years) with children well integrated into UK education points toward regularising the status of mother and children.
